Draft — not yet in effect. These terms are a working draft. Business decisions are still pending, and the terms must be reviewed by a qualified legal professional before publication. Highlighted items are placeholders. eSIM purchases are not yet available in the app.

1. About these terms

These Terms and Conditions ("Terms") govern your use of the DRIN eSIM mobile app and related services (the "Service"). The Service is provided by [operator legal name], [registered address], [company registration number] ("we", "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle your personal data.

Nothing in these Terms limits any rights you have as a consumer under the law that applies to you.

2. Definitions

  • eSIM: a digital SIM profile that can be downloaded onto a compatible device instead of using a physical SIM card.
  • Plan: a mobile data package for one or more destinations, with a data allowance and a validity period.
  • Supplier: the eSIM provider or network operator that supplies the connectivity behind a Plan.
  • Order: your purchase of a Plan through the app.

3. Eligibility

You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you need the permission of a parent or legal guardian to buy Plans.

The Service is offered to customers in the European Union and European Economic Area, and in Türkiye.

4. Your account

You sign in with Google or Apple. You are responsible for keeping access to your sign-in account secure and for activity under your account. Please keep your profile information accurate. You can delete your account at any time in the app under Account > Delete account.

5. The service

DRIN eSIM lets you browse and buy prepaid mobile data Plans for travel and install them as eSIMs on your device. Plan purchases, eSIM delivery and usage tracking are under development and will be available only once they launch in the app. We are a reseller: the mobile network service itself is provided by our Supplier and its partner network operators.

Plans are data-only. They do not include a phone number, calls or SMS.

6. Device compatibility

To use a Plan, your device must support eSIM and be unlocked, meaning it is not restricted to one carrier. Before buying, you are responsible for checking that your device is compatible. Device support can vary by model, region and operating system version.

7. Data plans and coverage

  • Each Plan's destination coverage, data allowance, validity period and other conditions are shown in the app before you buy. Those details form part of your agreement for that Plan.
  • Network coverage, speed and quality depend on the local network operator, your location, your device and network conditions. They are not guaranteed.
  • A Plan's validity period starts when the Plan is activated, which happens when the eSIM first connects to a supported network in a covered destination, unless the Plan details in the app say otherwise. Installing the eSIM before you travel does not start the validity period.
  • [Set rules for unused data and expiry, top-ups, and any fair-use limits.]
  • Some destinations may require identity verification under local regulations. [Confirm with the Supplier.]

8. Orders, prices and payment

  • Prices are shown in the app before you confirm an Order. [Confirm display currencies, for example EUR and TRY, and confirm that prices shown to consumers include VAT or other applicable taxes.]
  • Payment is processed by [payment provider to be confirmed: App Store / Google Play in-app purchase, or Stripe]. We do not store your full card details.
  • Your Order is confirmed when we send you an order confirmation in the app or by email. We may decline an Order, for example if a Plan becomes unavailable or a pricing error is identified. If we do, we will not charge you or will refund any amount paid.

9. Delivery, installation and activation

  • After a successful Order, we provide your eSIM installation details, such as a QR code or activation code, and instructions in the app.
  • You are responsible for installing the eSIM correctly and for your device settings, such as selecting the eSIM for mobile data and enabling data roaming where required.
  • Installation usually needs an internet connection. Some eSIM profiles can only be installed once. Removing the eSIM from your device may make it unusable. [Confirm with the Supplier.]
  • Keep your home carrier's roaming settings in mind. Charges from your home carrier are not covered by us.

10. Cancellations and refunds

Your statutory rights as a consumer are not affected by anything in this section.

Problems with your eSIM

If your eSIM cannot be installed, or does not work in a destination covered by your Plan, because of a problem on our side or our Supplier's side, contact support. We will try to fix it. If we cannot, you are entitled to a refund. This applies whether or not the eSIM was installed. [Confirm: full refund, or partial refund where part of the Plan was already used.]

To help us investigate, we may ask for your order number, device model and screenshots of your settings or error messages.

[Decide whether refunds are offered when the problem is caused by the device, for example an incompatible or carrier-locked phone.]

Right of withdrawal in the EU and EEA

If you are a consumer in the EU or EEA, you can usually withdraw from an Order within 14 days without giving a reason. Because a Plan is digital content, you lose this right once delivery of the eSIM begins, but only if, at checkout, you expressly asked for immediate delivery and acknowledged that you would lose the right of withdrawal. If you withdraw in time, we refund you within 14 days. [The checkout must collect this consent and acknowledgement. Legal review required.]

Consumers in Türkiye

Consumers in Türkiye have the rights given by Consumer Protection Law No. 6502 and the Distance Contracts Regulation. [Legal review: how the withdrawal exceptions for instantly delivered digital content apply.]

How to request a refund

Contact [support email] with your order number. Refunds go to your original payment method. If you paid through the App Store or Google Play, the refund may have to be requested through their process.

11. Acceptable use

You must not use the Service or any Plan:

  • for any unlawful purpose, or in breach of local laws in the destination;
  • to resell Plans without our written permission;
  • to interfere with or disrupt networks, or to attempt unauthorised access to our systems or other users' accounts; or
  • in breach of the Supplier's or network operator's usage policies notified to you.

12. Third-party providers

Connectivity is supplied by our Supplier, [eSIM provider name], and local network operators. Sign-in is provided by Google and Apple, and payments by [payment provider]. Their own terms may also apply to your use of their services.

13. Service availability

We aim to keep the app available, but it may sometimes be unavailable because of maintenance, updates or events outside our control. Network availability in a destination depends on the local operators.

14. Intellectual property

The app, website and their content are owned by us or our licensors. We grant you a personal, non-transferable licence to use the app for its intended purpose. You may not copy, modify or reverse-engineer it except where the law allows.

15. Liability

[Liability terms to be drafted by a legal professional for the applicable jurisdiction. Consumer protection laws limit what can be excluded. For example, liability for death or personal injury caused by negligence, or for fraud, cannot usually be excluded.]

16. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or close accounts that seriously or repeatedly breach these Terms, or where required by law. Where reasonable, we will give notice first. [Set out what happens to active Plans if an account is deleted or terminated.]

17. Support and complaints

For help with the app, a Plan or a complaint, contact [support email]. [Add response times, and any alternative dispute resolution or consumer body you are required to name.]

18. Changes to these terms

We may update these Terms, for example when new features such as eSIM purchases launch or when the law changes. We will tell you about significant changes in the app before they take effect and may ask you to accept the new version. Changes do not affect Orders already placed.

19. Governing law and disputes

[Governing law and courts to be confirmed once the operating company is formed, for example the laws of Estonia if the operator is an Estonian company. Legal review required.]

If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country. Consumers in Türkiye may also apply to consumer arbitration committees or consumer courts.
